- Chapter 7, erase qualifying debt in about four months and get a fresh start.
- Chapter 13, stop foreclosure and keep your home or car on a 3-to-5-year plan.
- Chapter 11 / Subchapter V, reorganize a Palm Beach County business while keeping it open.
- Wage garnishment defense, including Florida’s head-of-household exemption.
Stopping Wage Garnishment in Palm Beach County
If a creditor is garnishing your paycheck, or is about to, you have options. Filing bankruptcy triggers the automatic stay (11 U.S.C. § 362), which legally stops most wage garnishments the moment your case is filed. Florida law also offers strong protection on its own: under the head-of-household exemption (Fla. Stat. § 222.11), the wages of someone who provides more than half the support for a child or other dependent are generally exempt, earnings up to $750 a week are fully protected, and higher earnings stay protected unless you agreed to the garnishment in writing. We review whether that exemption applies to you, file the exemption claim, and, where bankruptcy is the right tool, use it to stop the garnishment and resolve the underlying debt. For more, see our Florida wage garnishment page.
Florida Exemptions That Protect Your Property
Florida’s exemptions protect most filers’ essential property: the homestead (primary residence, subject to acreage and the federal cap for recent buyers, Fla. Const. Art. X, § 4), head-of-household wages (§ 222.11), retirement accounts, up to $5,000 of motor-vehicle equity (Fla. Stat. § 222.25(1)), and a $4,000 wildcard if you don’t claim the homestead. Most Chapter 7 filers keep everything they own.
