However, a ruling from the Tampa Bankruptcy Court in August 2025 serves as a crucial warning: In Florida, if a tow truck arrives before you file your bankruptcy petition, the court may not be able to assist you.
Technical Analysis: The “Woodson” Decision & The Kalter Trap
- Case Name: In re Ayesha Latoya Woodson
- Case No: 8:25-bk-06080-CED (Dated: August 28, 2025)
- The Ruling: Judge Caryl E. Delano denied a Debtor’s “Emergency Motion for Turnover” for a repossessed vehicle.
- The Legal Expertise: This ruling is based on the 11th Circuit precedent in In re Kalter. where the court notes that legal title to the vehicle transfers to the lender the moment it is repossessed.
The “Woodson Trap”: Because title transfers upon “the hook,” the vehicle is no longer “property of the estate” under 11 U.S.C. § 541. The Automatic Stay does not apply because you no longer legally own the asset. As Woodson shows, filing a Chapter 13 even 4 days later is often too late to compel turnover. We recommend filing an emergency “skeletal” petition to stop the repo man before he arrives.
