Lost Your Car to Repossession? Why Timing is Everything in Florida

In the Tampa Bay area, many rely on their vehicles for their livelihoods. If you find yourself behind on payments, you might have heard that bankruptcy can help you recover your car. However, a ruling from the Tampa Bankruptcy Court in August 2025 serves as a crucial warning: In Florida, if a tow truck arrives before you file your bankruptcy petition, the court may not be able to assist you.

Technical Analysis: The “Woodson” Decision & The Kalter Trap

  • Case Name: In re Ayesha Latoya Woodson
  • Case No: 8:25-bk-06080-CED (Dated: August 28, 2025)
  • The Ruling: Judge Caryl E. Delano denied a Debtor’s “Emergency Motion for Turnover” for a repossessed vehicle.
  • The Legal Expertise: This ruling is based on the 11th Circuit precedent in In re Kalter. where the court notes that legal title to the vehicle transfers to the lender the moment it is repossessed.

The “Woodson Trap”: Because title transfers upon “the hook,” the vehicle is no longer “property of the estate” under 11 U.S.C. § 541. The Automatic Stay does not apply because you no longer legally own the asset. As Woodson shows, filing a Chapter 13 even 4 days later is often too late to compel turnover. We recommend filing an emergency “skeletal” petition to stop the repo man before he arrives.

Infographic showing two timelines for Florida vehicle repossession in Pasco County. The top red timeline, "The Trap," shows that waiting until after the repo agent arrives results in legal title transferring to the lender (Kalter Rule), meaning the court cannot return the vehicle even if bankruptcy is filed later (In re Woodson ruling). The bottom blue timeline, "The Solution," shows that calling Stiberman Law for a free consultation allows for an emergency "skeletal" petition to be filed, triggering the Automatic Stay and stopping the repo, resulting in the car being saved and payments restructured through a Chapter 13 plan.

Understanding Your Options: Chapter 7 vs. Chapter 13

At Stiberman Law, we believe that understanding your options empowers you to make informed decisions. Based on your income and assets, we will guide you toward the best path.

Chapter 7 Bankruptcy: The “Fresh Start”

Chapter 7 bankruptcy is designed to quickly wipe out unsecured debts, allowing you to move forward without a multi-year repayment plan.

  • 2026 Means Test Eligibility: To qualify, we use the Florida Median Income limits (Updated Nov 2025). For example, the limit for a 2-person household is $84,305. Even if you are “over-median,” we can often qualify you through expense deductions.
  • Speed: Most cases result in a total discharge within 4 to 6 months.
  • Asset Protection: Most Pasco clients can protect their property by using Florida’s robust exemptions.

Chapter 13 Bankruptcy: The “Reorganization”

Chapter 13 bankruptcy is the primary option for homeowners in Trinity or Seven Springs who are facing foreclosure.

  • Save Your Home: Spread missed mortgage payments (arrears) over a 3-to-5-year court-approved plan.
  • Mortgage Modification Mediation (MMM): We utilize the Tampa Division’s specialized MMM program to negotiate lower interest rates or principal reductions during your bankruptcy.
  • Cure HOA & Tax Debt: Resolve delinquent HOA dues or recent IRS taxes that a Chapter 7 cannot eliminate.
